Terms of purchase

The owner of the online store HOBUMATKAD.EE (hereinafter the Online Store) is ILMAVALD OÜ (registry code 12956525), located in Mustamõisa, Mustakurmu village, Põlva parish, 63707, Põlva county, Republic of Estonia.
 

Validity of sales contract, goods and price information

The terms of sale apply to the purchase of services and goods from the Online Store.


The prices of the services and products sold in the online store are indicated next to the products. A fee for additional hours of delivery of goods or provision of services is added to the price.


The delivery fee depends on the location of the buyer and the method of delivery. The delivery fee is displayed to the buyer when ordering.


Information about services and goods is provided in the Online Store directly next to services and goods.


Placing an order

To order a service or product, you must add the desired services or products to the shopping cart. To place an order, you must fill in the required data fields and select the appropriate time for providing the service or the method of delivery of the products. The amount of the fee, which can be paid via a bank link or another payment solution, is then displayed on the screen.

The agreement enters into force upon receipt of the amount due to the current account of the Online Store.

If the ordered service or goods cannot be delivered due to impossibility to provide the service, termination of the goods or for any other reason, the buyer shall be notified as soon as possible and the money paid (incl. Delivery costs) shall be refunded immediately, but not later than within 14 days.


Delivery

The goods are sent to the following countries: Republic of Estonia.

Shipping costs are borne by the buyer and the corresponding price information is displayed next to the shipping method.

Shipments within Estonia usually reach the destination specified by the buyer within 3-7 working days from the entry into force of the sales contract. Delivery outside Estonia takes place within 10 calendar days.

In exceptional cases, the right to deliver the goods within 45 calendar days.


Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days (valid only for goods!)

[depending on the products, the buyer may not have the right of withdrawal, the corresponding products and services must be listed in such a case and they must meet the conditions listed in § 53 (4) of the Law of Obligations Act].

The right of withdrawal does not apply if the buyer is a legal person.
In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to verify the nature, characteristics and functioning of the goods in the manner permitted for testing the goods in a physical store.

If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods or have signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods.

In order to return the goods, a withdrawal application must be submitted, the form of which can be found here: withdrawal application and sent to the e-mail address no later than within 14 days of receipt of the goods.

The costs of returning the goods shall be borne by the buyer, unless the reason for the return is the fact that the item to be returned does not correspond to what was ordered (eg a wrong or defective item).
The buyer must return the goods within 14 days of submitting the application or provide proof that he has handed over the goods to the carrier within the aforementioned period.
Upon receipt of the returned goods, the online store shall return to the buyer immediately, but not later than 14 days after receipt of the withdrawal application, all fees received from the buyer on the basis of the contract.

The online store may refuse to make refunds until the item that is the subject of the contract has been returned or until the buyer has provided proof that he has returned the item, whichever is earlier.

If the buyer has explicitly chosen a delivery method different from the cheapest usual delivery method offered by the Online Store, the Online Store does not have to reimburse the consumer for a cost that exceeds the cost related to the usual delivery method.

The online store has the right to withdraw from the sale transaction and demand the goods back from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to a mistake.


Right to lodge a claim

The online store is liable for non-compliance or defect of the services provided to the buyer and the goods sold, which already existed at the time of providing the service or delivery of the thing and which becomes apparent within two years from delivery to the buyer. During the first six months from the delivery of the thing to the buyer, it is presumed that the defect already existed at the time of delivery of the thing. It is the responsibility of the Online Store to rebut the respective presumption.


The buyer has the right to contact the online store within two months at the latest, by sending an e-mail to info ät hobumatkad.ee.

The online store is not responsible for defects that have occurred after the end of the service or delivery of the goods to the buyer.

If the services or goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective service or goods. If the service or goods cannot be repaired or replaced, the Online Store will return all fees associated with the sales contract to the buyer.

The online store shall respond to the consumer's complaint in writing or in a form that can be reproduced in writing within 15 days.


Direct marketing and processing of personal data

The online store uses the personal data entered by the buyer (incl. Name, telephone number, personal identification code, weight, address, e-mail address, bank details) only to process the order, provide the service and send the goods to the buyer. The online store transmits personal data to transport companies in order to deliver the goods.

The online store will send newsletters and offers to the buyer's e-mail address only if the buyer has expressed a wish by entering the e-mail address on the website and has announced his / her wish to receive direct mail notifications.

The buyer can cancel the offers and newsletters sent to the e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.


Solving arguments

If the buyer has any complaints regarding the Online Store, they must be sent to the e-mail address info ät hobumatkad.ee or by phone: +3725524138.

If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The terms of the procedure can be viewed and the application submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer's complaint in the commission is free of charge.

The buyer can turn to the European Union Consumer Dispute Resolution Platform.

Use of cookies

The online store uses cookies. A cookie is a small text file that a web browser automatically saves to a device used by a customer. Cookies are used to collect information about how the customer uses the Online Store in order to provide the customer with a better user experience.

The following cookies are used in the online store:

  • session cookies, the purpose of which is to enable the use of the Online Store;

  • persistent cookies, the purpose of which is to remember the customer's choices in the Online Store;

  • first and / or third party cookies designed to show the customer appropriate advertising and offers;

  • third-party analytics cookies designed to optimize marketing communications.

The customer may delete and / or block cookies stored on their devices by changing the corresponding settings of their web browser. If cookies are not used, the Online Store may not work as planned and / or some functionalities may not be available to the customer.

In addition to the use of analysis cookies, the Online Store uses pixel tags (web-beacons) to monitor the use of the seller's website. In doing so, personally identifiable information will not be processed.

PURPOSE OF THE PROCESSING OF PERSONAL DATA

Personal data is used to manage customer orders, provide services, enter into a deductible agreement and deliver goods.

Purchase history data (purchase date, goods, quantity, customer data) is used to compile an overview of purchased goods and services and to analyze customer preferences.

The bank account number is used to return payments to the customer.

Personal data, such as e-mail, telephone number, customer name, are processed to resolve issues related to the provision of goods and services (customer support).

The IP address or other network identifiers of the online store user are processed to provide the online store as an information society service and to compile online usage statistics.

 

LEGAL BASIS

Personal data is processed for the purpose of fulfilling the contract entered into with the customer.

The processing of personal data is carried out in order to fulfill a legal obligation (eg accounting and settlement of consumer disputes).

 

RECIPIENTS TO WHOM PERSONAL DATA ARE TRANSMITTED

Personal data is passed on to the online store's customer support to manage purchases and purchase history and to solve customer problems.

The name, telephone number and e-mail address will be forwarded to the transport service provider chosen by the customer. In the case of goods delivered by courier, in addition to the contact details, the customer's address will also be provided.

The accounting of the online store is performed by the service provider. Personal data is transferred to the service provider for performing accounting operations.

Personal data may be transferred to information technology service providers if this is necessary to ensure the functionality of the online store or data hosting.

 

SECURITY AND ACCESS TO DATA

Personal data is stored  ShopRoller.com  servers located in the territory of a Member State of the European Union or countries that have joined the European Economic Area. Data may be transferred to countries whose level of data protection has been assessed as adequate by the European Commission and to US companies that are affiliated to the Privacy Shield framework.

The employees of the online store have access to personal data, who can access the personal data in order to resolve technical issues related to the use of the online store and to provide customer support services.

The Online Store implements appropriate physical, organizational and IT security measures to protect personal data from accidental or unlawful destruction, loss, alteration or unauthorized access and disclosure.

The transfer of personal data to the authorized processors of the online store (eg transport service provider and data hosting) takes place on the basis of agreements concluded with the online store and the authorized processors. Authorized processors are obliged to ensure appropriate safeguards for the processing of personal data.

 

ACCESS AND CORRECTION OF PERSONAL DATA

Personal data can be accessed and corrections made to the online store's user profile. If the purchase has been made without a user account, personal data can be accessed via customer support.

 

WITHDRAWAL OF CONSENT

If the processing of personal data takes place on the basis of the customer's consent, the customer has the right to withdraw the consent by notifying the customer support by e-mail.

 

STORAGE

When closing the customer account of the online store, personal data will be deleted, unless such data needs to be stored for accounting or resolving consumer disputes.

If the purchase in the online store has been made without a customer account, the purchase history will be stored for three years.

In the case of disputes related to payments and consumer disputes, personal data will be kept until the claim is fulfilled or the limitation period expires.

Personal data required for accounting purposes shall be kept for seven years.

 

DELETION

To delete personal information, contact customer support via email. A request for erasure shall be answered no later than one month and the period for erasure of data shall be specified.

 

TRANSFER

A request for the transfer of personal data submitted by e-mail will be answered within a month at the latest. Customer support identifies and notifies you of the personal data that is to be transferred.

 

DIRECT MARKETING NOTICES

The e-mail address and telephone number will be used to send direct marketing messages if the customer has given his consent. If the customer does not wish to receive direct marketing communications, please select the appropriate link in the footer of the email or contact customer support.

If personal data is processed for direct marketing purposes (profiling), the customer has the right to object at any time to the initial and further processing of his personal data, including direct marketing profiling by notifying customer support by e-mail (this must be clearly and separately from any other information) .

 

SOLVING ARGUMENTS

Disputes related to the processing of personal data are resolved through customer support at info ät hobumatkad.ee. The supervisory authority is the Estonian Data Protection Inspectorate (info@aki.ee).
